1. Acceptance of Terms

By accessing and using Monster Survivor (the "Game") and the website monstersurvivorsgame.live (the "Website"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Monster Survivor provides users with access to an online browser-based game and related content (the "Service"). The Service is provided "as is" and on an "as available" basis without warranties of any kind, either express or implied.

3. User Conduct

You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Website. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content or disrupting the normal flow of dialogue within the Game.

• Use any cheats, hacks, or third-party software designed to modify the game experience
• Exploit bugs or unintended features of the game
• Use multiple accounts to gain unfair advantages
• Engage in any activity that disrupts the game service or negatively affects other players' experiences
• Attempt to access areas of the game or website that are not intended for player access
• Reverse engineer, decompile, or disassemble any portion of the game

4. Intellectual Property

The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Website and Game are protected under applicable copyrights, trademarks and other proprietary rights. The copying, redistribution, use or publication by you of any such matters or any part of the Website, except as allowed by Section 5 below, is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through the Website.

5. Limited License

We grant you a non-exclusive, non-transferable, limited right to access, use and display the Website and the materials provided hereon, provided that you comply fully with these Terms of Service.

6. User Account

If the Service requires you to create an account, you must complete the registration process by providing accurate and complete information as prompted by the registration form. You are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your account.

7. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, we do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Website or otherwise relating to such materials or on any sites linked to this site.

9. Limitation of Liability

In no event shall Monster Survivor, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

10. Indemnification

You agree to defend, indemnify and hold harmless Monster Survivor, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
